Each year following the year of notification, the operator receives a letter reminding him of these notification obligations. The form to be used, drawn up in accordance with Article 5 (on notification by operators) point 1 of the Regulation, is sent at the same time as the letter. The forms sent must be accompanied by any document, calculation or explanation to justify the values declared. Emissions to air / discharges to water and waste shipments are validated by checking the data and, among other things : - the calculation method and conversion rules ; - the measurements used: by comparing the measurement results supplied with measurements carried out by Brussels Environment; - the list of substances emitted is compared with the list of substances in appendices 4 and 5 of the guidance document for implementation of the European PRTR; - emission factors are compared with those quoted in the literature, - annual trends;- a comparison is made with the data available within BE on the basis of other reporting obligations (e.g. the real cost of water treatment, the waste register, etc.), The European Commission also assesses the data submitted, mainly on the basis of previous and national data. De kwaliteit van de verstrekte gegevens wordt geregeld door artikel 9 betreffende de kwaliteitsborging en -beoordeling van de E-PRTR-verordening en paragraaf 4 van artikel 2 van het Besluit van de Brusselse Hoofdstedelijke Regering van 13 november2008 houdende de verplichting tot periodieke kennisgeving van milieugegevens voor bepaalde ingedeelde industriële inrichtingen. Elk jaar na het jaar van de kennisgeving ontvangt de exploitant een brief die hem aan deze kennisgevingsverplichtingen herinnert tegen 30 juni. Het te gebruiken formulier dat werd opgesteld volgens artikel 5 (in verband met de kennisgeving door de exploitanten), punt 1 van de Verordening, wordt samen met de aldus verstuurde brief bezorgd. De overgemaakte formulieren moeten vergezeld zijn van alle documenten, berekeningen en toelichtingen waarmee de opgegeven waarden gestaafd kunnen worden. De emissies in de lucht / de lozingen in het water en de afvaloverbrengingen worden gevalideerd door het controleren van de gegevens en van o.a.: • de berekeningswijze en de conversieregels; • de gebruikte meting: door de resultaten van de bezorgde metingen te vergelijken met de metingen die door Leefmilieu Brussel werden verricht; • de lijst van de uitgestoten stoffen wordt vergeleken met de lijst van de stoffen die zijn opgenomen in de bijlagen 4 en 5 van het document met richtsnoeren voor de totstandbrenging van het Europees PRTR; • de emissiefactoren worden vergeleken met die vermeld in de literatuur; • de jaarlijkse tendensen; • er wordt een vergelijking gemaakt met de gegevens die binnen het BIM beschikbaar zijn op basis van andere rapporteringsverplichtingen (bv. de reële zuiveringsprijs van water, het afvalregister, enz.). Ook de Europese Commissie onderwerpt de bezorgde gegevens op haar niveau aan een evaluatie en dat voornamelijk op basis van eerdere en nationale gegevens. Deze controles hebben de volgende voornaamste tekortkomingen aan het licht gebracht: cijfer- of berekeningsfouten, gedeeltelijk gebruik van nochtans beschikbare gegevens of vergeten te vermelden van de vereiste gegevens. De exploitanten worden dan ook uitgenodigd om hun aangiften te corrigeren/aan te vullen op straffe van sancties. La qualité des données fournies est régie par l’article 9 relatif à l’assurance et évaluation de la qualité du Règlement E-PRTR et paragraphes 4 de l’article 2 de l’Arrêté du Gouvernement de la Région de Bruxelles-Capitale du 13 novembre 2008 relatif à l’obligation de notification périodique de données environnementales pour certaines installations industrielles classées. Chaque année suivant celle de notification, l’exploitant reçoit un courrier lui rappelant ces obligations de notifications.
